Note to Correspondents – Discussions on the possible establishment of an international, impartial, independent, and autonomous mechanism against corruption and impunity in Honduras

Yesterday, Eduardo Enrique Reina García, Secretary for Foreign Affairs and International Cooperation of Honduras, and Miroslav Jenča, Assistant Secretary-General for Europe, Central Asia and the Americas, discussed the status of implementation of the Memorandum of Understanding between the United Nations Secretariat and Honduras on a future mechanism against corruption and impunity. They also discussed the joint way forward.

Prior to their discussion, and in accordance with the Memorandum signed on 15 December 2022, the Secretariat deployed on four occasions a team of United Nations experts to Honduras. These technical visits aimed to assist the Government in identifying and taking forward the necessary constitutional, legal and administrative reforms to meet the required legal guarantees and requirements for the possible establishment of a future mechanism against corruption and impunity in Honduras.

The team of experts identified the required basic reforms and the Secretariat communicated them to its Honduran counterparts. These reforms include those allowing a future mechanism to be established and to operate effectively within the Honduran legal framework. While progress has been achieved, significant reforms remain to be approved to meet the necessary minimum legal guarantees and requirements for the mechanism to be established. To this end, the Secretariat and the Government have agreed to explore an extension of the Memorandum of Understanding to continue to cooperate, including through the provision of technical assistance by the United Nations regarding outstanding reforms.

In parallel, the Secretariat remains ready to discuss the terms of a possible bilateral agreement with the government, on the basis of a proposal made by Honduras, and awaits the designation of the Government’s representatives for such discussions.

As agreed by the parties in the Memorandum, a mandate emanating from one of the intergovernmental bodies of the United Nations should exist for the mechanism to be established. Further, the Secretariat and the Government would need to agree in writing on the existence of minimum legal guarantees, and the negotiated bilateral agreement for the mechanism would need to enter into force.

The Secretariat remains committed to supporting the people and the Government of Honduras in the strengthening of the rule of law and the fight against corruption and impunity.

Nota para corresponsales - Discusiones relativas al posible establecimiento de un mecanismo internacional, imparcial, independiente y autónomo contra la corrupción y la impunidad en Honduras

El Sr. Eduardo Enrique Reina García, Secretario de Relaciones Exteriores y Cooperación Internacional de Honduras, y Sr. Miroslav Jenča, Subsecretario General para Europa, Asia Central y las Américas, discutieron ayer el estado de la implementación del Memorándum de Entendimiento entre la Secretaría de las Naciones Unidas y el Gobierno de Honduras, así como el camino conjunto a seguir.

Previo a su llamada y de conformidad con el Memorándum firmado el 15 de diciembre de 2022, la Secretaría ha desplegado en cuatro ocasiones un equipo de expertos de las Naciones Unidas en Honduras. El objetivo de estas visitas técnicas era asistir al Gobierno a identificar y llevar adelante las reformas constitucionales, legales y administrativas necesarias para cumplir con las garantías y requisitos legales mínimos para el eventual establecimiento de un futuro mecanismo contra la corrupción y la impunidad en Honduras.

El equipo de expertos determinó las reformas básicas necesarias y la Secretaría las comunicó a su contrapartes hondureñas. Estas reformas incluyen aquellas que permitieran establecer un mecanismo futuro y funcionar eficazmente dentro del marco jurídico hondureño. Si bien se han logrado avances, aún quedan por aprobar importantes reformas para cumplir con las garantías y requisitos legales mínimos necesarios para que se establezca el mecanismo. Con este fin, la Secretaría y el Gobierno han acordado explorar una extensión del Memorándum de Entendimiento para continuar cooperando, incluyendo mediante la prestación de asistencia técnica por parte de las Naciones Unidas en relación con las reformas pendientes.

Paralelamente, la Secretaría sigue dispuesta a examinar los términos de un eventual acuerdo bilateral con el Gobierno, sobre la base de la propuesta presentada por Honduras, y espera la designación de los representantes del Gobierno para esas conversaciones.

Según lo acordado por las partes en el Memorándum, para que se establezca el mecanismo debería existir un mandato emanado de uno de los órganos intergubernamentales de las Naciones Unidas. Asimismo, la Secretaría y el Gobierno tendrían que acordar por escrito la existencia de garantías y requisitos jurídicos mínimos para su establecimiento y funcionamiento y el acuerdo bilateral negociado para el mecanismo tendría que entrar en vigor.

La Secretaría mantiene su compromiso de apoyar al pueblo y al Gobierno de Honduras en el fortalecimiento del estado de derecho y la lucha contra la corrupción y la impunidad.
