The United Nations Secretariat and the Government of Honduras signed a Memorandum of Understanding (MOU) on 15 December 2022 initiating work towards the possible establishment of an international, independent, impartial, and autonomous mechanism against corruption and impunity in Honduras, as requested by the Government. According to the MOU, a team of experts of the United Nations would be deployed under the first phase of cooperation between the Government and the United Nations Secretariat to provide technical assistance. On 26 April, the United Nations Secretariat received the Government’s approval of the Terms of Reference for the dispatch of the team of experts of the United Nations, a draft of which the Secretariat had shared with the Government in January.

In accordance with the MOU and the agreed Terms of Reference, a team of experts of the United Nations will now assist the Government in laying the necessary foundations for the possible establishment of an international, independent, impartial, and autonomous mechanism. The team of experts will provide technical assistance to assess national instruments, institutions capacities and legislation; and identify, as well as support, needed reforms for the possible establishment of the mechanism.

In parallel to the work of the United Nations team of experts, the United Nations Secretariat and the Government of Honduras will negotiate the terms of the bilateral agreement required for the establishment of a mechanism.

The mechanism will only come into being when (a) the bilateral agreement enters into force, (b) the United Nations Secretariat and the Government agree in writing on the existence of minimum legal guarantees and requirements for its operation, and (c) an intergovernmental body of the United Nations has granted a mandate. At that point, and to guarantee its independence, impartiality and autonomy, the mechanism’s leadership would be appointed by the Secretary-General.

The United Nations Secretariat remains committed to supporting Honduras in its efforts to fight impunity and strengthen rule-of-law institutions.

El 15 de diciembre de 2022, la Secretaría de las Naciones Unidas y el Gobierno de Honduras firmaron un Memorando de Entendimiento (MOU) para iniciar el trabajo hacia el eventual establecimiento de un mecanismo internacional, independiente, imparcial y autónomo contra la corrupción y la impunidad en Honduras como lo solicito el Gobierno. Según lo acordado en el MOU, y con el propósito de brindar asistencia técnica, la primera fase de cooperación entre el Gobierno de Honduras y la Secretaría de las Naciones Unidas consistiría en el despliegue de un equipo de expertos de la Organización. El 26 de abril, la Secretaría de las Naciones Unidas recibió la aprobación del Gobierno de los Términos de Referencia para el envío del equipo de expertos de las Naciones Unidas, en seguimiento a un borrador compartido por la Secretaría con el Gobierno en enero. 
 
De acuerdo con el MOU y los Términos de Referencia acordados, un equipo de expertos de las Naciones Unidas asistirá al Gobierno de Honduras a sentar las bases necesarias para el eventual establecimiento de un mecanismo internacional, independiente, imparcial y autónomo. El equipo de expertos de las Naciones Unidas proporcionará asistencia técnica para evaluar los instrumentos, instituciones, capacidades y legislación nacionales, e así como para identificar y apoyar las reformas necesarias para el eventual establecimiento del citado mecanismo.
 
En paralelo al trabajo del equipo de expertos de las Naciones Unidas, la Secretaría de las Naciones Unidas y el Gobierno de Honduras negociarán los términos del acuerdo bilateral requerido para el establecimiento del eventual mecanismo.

Así, el mecanismo sólo entrará en vigor cuando: (a) el citado acuerdo bilateral entre en vigencia, (b) la Secretaría de las Naciones Unidas y el Gobierno acuerden por escrito la existencia de garantías legales mínimas y requisitos para su funcionamiento, y (c) un órgano intergubernamental de las Naciones Unidas haya otorgado el mandato correspondiente. Será entonces cuando el Secretario General, nombre al liderazgo del mecanismo, en aras de garantizar su independencia, imparcialidad y autonomía.

La Secretaría de las Naciones Unidas continúa comprometida a apoyar al Gobierno de Honduras en sus esfuerzos por combatir la impunidad y fortalecer las instituciones garantes del Estado de derecho.
